General Terms and Conditions of CampusSport

(1) The following provisions govern the general terms and conditions for participation in the CampusSport of the Frankfurt University of Applied Sciences – hereinafter referred to as CampusSport.

(2) By registering and booking an offer or participating in it, the participant accepts these General Terms and Conditions. They are therefore part of the contract between the participant and CampusSport.

(1) Members (students, employees) of Frankfurt University of Applied Sciences (Frankfurt UAS) and students of the cooperating Goethe University Frankfurt are eligible to participate.

(2) Non-university members - hereinafter referred to as guests/alumni - may participate if there is free capacity and must be 18 years of age or older.

(3) A fee is payable for participation in the programs. The amount of the fee depends on the participant's membership of one of the following status groups:

Status group 1: Students of Frankfurt UAS and the cooperating Goethe University Frankfurt
Status group 2: Employees of Frankfurt UAS.
Status group 3: Persons who do not belong to any of the above-mentioned status groups.

(1) Access to all rooms and sports facilities used for CampusSport events is only permitted to authorized participants.

(2) The hall may only be entered in clean indoor shoes with non-staining soles, which are used exclusively in sports halls. For all outdoor sports, further regulations regarding footwear apply, which are listed in the respective user regulations. Suitable clothing appropriate to the setting must be worn during the activities. The relevant instructions in the respective course descriptions must be observed.

(3) Photographing or filming instructors and participants in CampusSport events is strictly prohibited. Such recordings are only permitted after prior consultation with the CampusSport management and with the express consent of the persons concerned.

(4) CampusSport is entitled to take photos and film recordings during events. The photos and film recordings may be published by CampusSport without restriction in terms of time, space, subject matter and content. Participants assign the rights to the image to CampusSport.

(5) It is strictly forbidden to bring animals to events.

(6) For the use of all sports facilities, the usage regulations of the respective facility also apply, which contain regulations for proper and intended use. The usage regulations are binding.


(7) The instructions of the instructors and other persons exercising domiciliary rights must be followed. All behavior that runs counter to the orderly running of CampusSport, disturbs others or poses a risk to persons, buildings or property must be refrained from.

(1) Registration takes place exclusively via the CampusSport website. By registering, the participant submits a binding offer to conclude a contract with CampusSport, which CampusSport accepts by sending the registration confirmation.

(2) Additional agreements that change the scope of the contractual services must be confirmed in writing by CampusSport in order to be valid.

(3) A separate participation ticket must be booked for each offer. The booked event is listed and acknowledged on the participation ticket.

(4) The printed participation ticket, proof of membership of the status group (student ID) and a valid photo ID must always be carried with you when participating in CampusSport and must be presented without being asked in the event of checks by CampusSport staff and other persons exercising domiciliary rights. Participants who are unable to show appropriate identification will be denied participation in events and access to the sports facilities.

(5) The participation ticket is non-transferable.

(1) Payment is always made by direct debit. By registering, the participant revocably authorizes CampusSport to collect the fee for the booked offer. If payment cannot be made, the registration will be canceled and the participant's right to participate will be revoked. Any resulting costs for the return debit note shall be borne by the participant. If the direct debit is not possible due to insufficient funds or incorrect contact details, the resulting costs of at least EUR 8.50 shall be borne by the participant.

(1) The participant has no right to withdraw from the contract.

(2) In justified exceptional cases (injury, loss of place, etc.), CampusSport reserves the right to make an exception as a gesture of goodwill. In this case, CampusSport will refund the collected course fee eight weeks after receipt of payment. If the participant objects to a returned direct debit, the participant undertakes to bear the additional costs incurred (depending on the bank in question, these are bank charges of varying amounts) for Frankfurt University of Applied Sciences.

(3) Places that become free cannot be transferred to other persons, but can only be returned to CampusSport.

CampusSport reserves the right to cancel courses for compelling reasons, e.g. failure to reach the required number of participants, formal errors, etc.. In this case, the registration will be canceled and the course fee already collected will be refunded eight weeks after receipt of payment. If the participant does not wish to wait the required eight weeks, a return debit note can be issued by means of an objection. In this case, however, the participant undertakes to bear the additional costs incurred by Frankfurt University of Applied Sciences (depending on the bank in question, these are bank charges of varying amounts). There is no further claim against CampusSport or Frankfurt UAS.

(1) The offers include the services described in the respective sports program. These are group events for which individual services are not guaranteed. There is no entitlement to a specific instructor, a specific type of instruction or to the use of specific rooms or equipment.

(2) The respective valid offer periods are shown on the participation ticket.

(3) Announced events may be canceled without entitlement to compensation for the following reasons:

if the course day falls on a public holiday or during a lecture-free period,
if the course leader is unable to attend and CampusSport is unable to find a qualified replacement at short notice,
in the event of operational disruptions (due to construction work, repairs, etc.),
if the respective sports facility is occupied by courses, tournaments, further training or other events,
due to weather conditions and
in the event of force majeure.
(4) CampusSport may combine or cancel offers if there are too few registrations. In this case, participants can choose another course of their choice within the same fee group in the current program, subject to availability. It is also possible to withdraw from the booked program. Any fees already paid will then be refunded. There is no further claim against CampusSport or Frankfurt UAS.

(1) Exercise instructors are entitled to exclude participants from the courses if their behavior significantly endangers their health or the health and well-being of other participants despite warnings.

(2) A breach of the conditions of participation, regulations or instructions of CampusSport can lead to the withdrawal of the right to participate or, in the case of the use of rooms and sports facilities, to expulsion from the premises. Exercise instructors and other persons exercising domiciliary rights are authorized to confiscate participation tickets.

(3) Anyone who repeatedly or seriously violates the conditions of participation, regulations or instructions of CampusSport may be permanently excluded from participating in CampusSport activities. This applies in particular to the endangerment of persons, improper use of sports facilities and equipment as well as misuse of the right to participate. The decision on exclusion is made by the CampusSport management.

(4) In the event of exclusion due to misconduct on the part of the participant, the fees paid will not be refunded.

By booking an offer from CampusSport, the participant gives his/her consent for CampusSport to collect, process and use personal data for the purposes of participant administration and organizational measures in compliance with data protection regulations. This consent can be revoked in writing at any time with effect for the future.

(1) Claims for damages in the context of CampusSport offers can only arise in cases of intent and gross negligence. Any further liability for damages on the part of CampusSport, Frankfurt UAS, the State of Hesse, the cooperating universities, their members or against exercise instructors is excluded.

(2) If borrowed sports materials and/or equipment are partially or completely damaged or not returned, the borrower is liable for damages.

(3) Frankfurt UAS accepts no liability for theft, damage to property or other damage to the sports facilities used by CampusSport.

(4) CampusSport is not liable for damages caused by third parties during the event.

(1) The accident insurance regulations of the Unfallkasse des Landes Hessen apply to employees and students:

Students of Frankfurt UAS and the cooperating universities are covered by accident insurance through the Unfallkasse des Landes Hessen (Accident Insurance Fund of the State of Hesse) insofar as they participate in events that take place within the organized exercise operation of CampusSport during fixed times and under the direction of an appointed exercise instructor. There is therefore no insurance cover for free practice and match operations.
Employees of Frankfurt UAS are covered by statutory accident insurance when participating in university sports if the sport has a compensatory and non-competitive character, the group of participants is essentially limited to university members, the sport takes place regularly and the exercise time and duration are related to the compensatory purpose.
For civil servants, an accident in the context of CampusSport is not usually considered an accident on duty. There is no entitlement to accident insurance. Private insurance cover is therefore strongly recommended for all employees.
(2) Guests who take part in Frankfurt UAS activities are not insured. They are responsible for their own insurance cover.

(3) Accident reports must be submitted to CampusSport in writing within three days.

CampusSport reserves the right to amend and adapt its General Terms and Conditions and will draw attention to these in the event of amendments or adaptations. Participants may object to the respective change in writing within a period of two weeks. If no objection is made, the amendment or adjustment is deemed to have been accepted.

(1) You can borrow the equipment package from the sports office for the duration of the course for a deposit. The equipment will be returned to the sports office at the end of the course and you will receive the deposit back.

(2) The deposit will be debited from your account.

(3) In the event of loss, damage or excessive wear and tear (no further use possible) of the equipment, CampusSport reserves the right to replace the affected item and deduct the purchase price from the deposit.

The following General Terms and Conditions of Excursions also apply to excursions:

General excursion conditions

(1) The following provisions govern the general conditions for participation in the excursions offered by CampusSport at Frankfurt UAS - hereinafter referred to as CampusSport.

(2) They do not apply to excursions that are not organized by CampusSport but by an external third party. For these, only the general terms and conditions of the external third party apply. The contract is concluded between the third party and the participant. Such excursions are specially marked on the Frankfurt UAS website. By registering for such an excursion via CampusSport, the participant consents to CampusSport passing on his/her personal data to the external provider of the excursion solely for the purpose of registration.

(3) By registering and booking an excursion, the participant accepts these excursion conditions. They are therefore part of the contract between the participant and CampusSport.

(1) Registration for the excursions takes place via the CampusSport website, depending on the course offered.

(2) By registering, the participant submits a binding offer to conclude a contract with CampusSport, which CampusSport accepts by sending the registration confirmation.

(3) When registering for the excursion, a deposit of EUR 150 is due, depending on the course offered. The balance is to be paid no later than 6 to 8 weeks before the start of the excursion. Payment is always made by direct debit.

(4) By registering, the participant revocably authorizes CampusSport to collect the fee for the booked offer. The direct debit authorization includes both the debit of the deposit and the remaining payment.

(5) Individual billing is not possible if partial services are waived.

(6) If the direct debit is not possible due to insufficient funds or incorrect contact details, the resulting costs of at least 8.50 euros are to be borne by the participant. CampusSport reserves the right to cancel the registration for the excursion and to withdraw the participant's entitlement to participate.

(1) The contractual scope of services of the excursions is generally determined by the valid CampusSport invitation to tender.

(2) Should additional requirements be necessary for participation in the excursion, CampusSport will expressly point these out in the invitation to tender. Additional requirements may include, but are not limited to, health certificates or sailing licenses, etc. 

(3) If arrival and departure are included in the excursion price, they are obligatory. If the arrival or departure is not made or is made privately, the participant is not entitled to a pro rata refund. This also does not constitute grounds for withdrawal.

(4) If travel to and from the excursion is not included in the excursion price, the participant is responsible for organizing this.

(4) CampusSport is entitled to pass on price increases for transportation (e.g. increase in fees or sharp rise in fuel costs) that occur after the participant has registered to all participants on a pro rata basis.

(1) The registered participant may withdraw from the excursion. The withdrawal must be declared in writing to CampusSport.

(2) In the event of withdrawal, a processing fee of 50 euros will be charged regardless of the time of withdrawal.

(3) If the withdrawal is made within six weeks before the start of the excursion, the refund amount will be reduced by a further 30%, from three weeks before the start of the excursion by 50% and from two weeks before the start of the excursion by 80%. If the withdrawal is made less than one week before the start of the excursion, a refund of the excursion fee is not possible.

(4) The declaration of withdrawal must be received by CampusSport in writing. The date of withdrawal is determined by the date of receipt of the declaration of withdrawal by CampusSport.

(5) In the event of non-attendance, the entire excursion fee will be retained.

(6) If the participant departs early, this will be at the participant's expense. A refund is excluded.

(7) Up until the start of the excursion, the participant may propose in writing to CampusSport that a third party enter into the rights and obligations of the contract in their place. CampusSport may object to this proposal if the third party does not meet the special requirements for the excursion or if there are other important reasons against the entry of the third party. In the event that the contract is accepted, the substitute participant (third party) and the original participant are jointly and severally liable to CampusSport for the payment of the excursion fee and any costs arising from the acceptance of the contract.

CampusSport reserves the right to cancel excursions for compelling reasons, e.g. weather conditions, force majeure, failure to reach the required number of participants, etc.. In this case, the registration will be canceled and the excursion fee already collected will be refunded. There is no further claim against CampusSport or Frankfurt UAS.

 

1) Participation in CampusSport excursions is at the participant's own risk. Claims for damages in the context of the excursions offered can only arise in cases of intent and gross negligence. Any further liability on the part of CampusSport or Frankfurt UAS, its employees or excursion leaders is expressly excluded. Participants in excursions are advised to take out adequate liability insurance to cover claims arising from personal injury or damage to property by third parties. In addition, participants in excursions are recommended to take out travel cancellation, travel health, travel accident and luggage insurance.

(2) CampusSport accepts no liability for damage caused by third parties during the event.

(3) In the event of bad weather, business interruption or natural disasters, there is no entitlement to compensation or reimbursement.

Each participant is responsible for ensuring that he/she is adequately covered during the excursion by taking out the appropriate insurance. All insurance claims must be made by the participant directly to the respective insurer.

 

The participant is responsible for ensuring that he/she complies with the passport, customs, visa, foreign exchange and health regulations of the respective country. Any fees incurred by the participant in connection with compliance shall be borne by the participant. Any disadvantages arising from non-compliance with these regulations shall be borne by the participant. The participant shall bear all costs in this regard.

 

(1) The participant will familiarize him/herself with the customs and traditions of the host country before the excursion and respect them during the excursion.

(2) Should the participant grossly violate an expected behavior or instructions from CampusSport or its authorized persons or disrupt the travel group or the course of the trip, he/she may be excluded from the further course of the excursion without reimbursement of the excursion fee. Any costs incurred as a result, e.g. for an unscheduled return journey, shall be borne solely by the participant.
